Warranty
357fab Warranty, Installation & Liability Terms
These terms apply to products, fittings, hose assemblies and other components supplied by 357fab.
1. Product Warranty
357fab stands behind the products and hose assemblies we supply.
Where a product supplied by 357fab has a defect in materials or workmanship, the product will be assessed and, where appropriate, repaired, replaced or otherwise dealt with in accordance with the applicable manufacturer’s warranty, these terms and the Australian Consumer Law.
Any warranty offered by 357fab is in addition to, and does not replace, rights available under the Australian Consumer Law.
2. Installation Responsibility
Unless installation has been specifically carried out by 357fab, the customer and/or installer is responsible for ensuring all products are correctly selected and installed for their intended application.
This includes ensuring:
-
hoses and fittings are correctly installed, tightened and secured;
-
hoses are routed clear of sharp edges, moving components and sources of excessive heat;
-
appropriate allowances are made for engine, suspension and component movement;
-
hoses are not twisted, kinked, excessively bent or placed under tension;
-
products are compatible with the fluid being carried;
-
operating pressures and temperatures remain within the product's specifications;
-
appropriate clamps, supports, heat shielding and protective sleeves are used where required; and
-
the installation is checked for leaks and correct operation before the vehicle or equipment is placed into service.
3. Inspection and Maintenance
Hoses, fittings and associated components are service items and should be inspected regularly.
Customers should check for signs of:
-
leaks;
-
abrasion or chafing;
-
cracking or deterioration;
-
heat damage;
-
corrosion;
-
loose fittings;
-
damaged or displaced hose supports;
-
excessive movement; and
-
any other indication that a component may require repair or replacement.
Any component showing signs of damage, leakage or deterioration should not remain in service.
4. Warranty Exclusions
To the extent permitted by law, warranty does not apply where a product failure or damage results from circumstances including:
-
incorrect installation;
-
incorrect product selection;
-
incorrect hose routing;
-
modification of the supplied product;
-
misuse or abuse;
-
accident or impact;
-
abrasion or external damage;
-
exposure to excessive heat;
-
operation above the rated pressure or temperature;
-
incompatible fuels, oils, chemicals or other fluids;
-
contamination;
-
inadequate servicing or inspection;
-
incorrect tightening or assembly of fittings;
-
use for an application for which the product was not designed or recommended; or
-
continued operation after a leak, fault or other problem became apparent.
5. Custom Hose Assemblies
Where 357fab manufactures a hose assembly to specifications provided by the customer, the customer is responsible for ensuring that the requested specifications are suitable for their intended application.
This includes dimensions, fitting types, fitting orientation, hose type, operating pressure, temperature and fluid compatibility.
357fab remains responsible for defects in the materials and workmanship of the assembly itself, subject to these terms and applicable law.
6. Customer-Supplied Components
Where 357fab assembles or modifies products using components supplied by a customer, 357fab does not warrant the condition, quality, suitability or performance of the customer-supplied components.
Any warranty provided by 357fab in such circumstances applies only to the work performed by 357fab, subject to applicable law.
7. Vehicle and Equipment Damage
Where permitted by law, 357fab is not responsible for damage, loss or costs resulting from incorrect installation, misuse, unsuitable application, improper maintenance, modification, or other circumstances outside 357fab's control.
This may include damage to engines, transmissions, fuel systems, oil systems, machinery, vehicles or other equipment arising from those circumstances.
This limitation does not apply where 357fab is legally responsible for loss or damage resulting from a failure to comply with an applicable consumer guarantee.
Australian Consumer Law may entitle a customer to compensation for loss or damage where that loss was caused by a failure to comply with a consumer guarantee and was reasonably foreseeable.
8. Labour and Consequential Costs
Where permitted by law, any voluntary warranty provided by 357fab does not automatically cover costs including:
-
removal or installation labour;
-
diagnosis by another workshop;
-
towing or transport;
-
vehicle or machinery downtime;
-
loss of use;
-
hire vehicles;
-
lost income or profits; or
-
other incidental or consequential expenses.
However, this clause does not exclude any entitlement to compensation that a customer may have under the Australian Consumer Law for reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee.
9. Motorsport and Competition Use
Products used in motorsport, competition, racing, track events or other unusually demanding applications may experience substantially greater loads, heat, vibration and wear than products used in normal road applications.
Customers are responsible for carrying out appropriate inspection and maintenance before and after such use.
Nothing in this clause excludes any statutory rights that cannot legally be excluded.
10. Making a Claim
If you believe a product supplied by 357fab has failed due to a defect, stop using the product as soon as it is safe to do so and contact 357fab.
Please provide, where available:
-
proof of purchase;
-
details of the product or hose assembly;
-
details of the vehicle or application;
-
a description of the failure;
-
photographs of the product and installation; and
-
any other information reasonably required to assess the claim.
Products may need to be returned to 357fab for inspection before the cause of failure can be determined.
Do not dispose of, dismantle or modify a failed product before contacting 357fab where doing so could prevent the cause of failure from being assessed.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These statutory rights apply in addition to any warranty provided by 357fab.
